Our website grants you non-exclusive limited license to use the PushFlew services sold through our website (https://pushflew.com/) by Ebizon (the “products”) in accordance with these Terms & Conditions (the “license”) issued by our company.

AUTOMATIC UPGRADE SERVICE

Access to our Automatic Upgrades Service is available to customers in accordance with the license purchased who have an active license key. A Business license provides automatic upgrades for a single site and a Developer license provides automatic upgrades for unlimited sites for you or your clients. You may not resell access to your license key.

Upgrades are provided for a term of 1 year from the time of purchase. After 1 year a renewal of your license must be purchased in order to continue receiving support and product upgrades. When you initially purchase your license, you’ll be signed up for your license renewals to be automatically billed yearly.

DELIVERY

If you register for a free tier or trial of the Service, we will make the Service available to you on a trial basis free of charge until the earlier of (a) the end of the free trial period or (b) the start date of your subscription. If we include additional terms and conditions on the trial registration web page, those will apply as well. During the free trial period, (i) the Service is provided “as is” and without warranty of any kind, (ii) we may suspend, limit, or terminate the Service for any reason at any time without notice, and (iii) we will not be liable to you for damages of any kind related to your use of the Service. Unless you subscribe to the Service before the end of the free trial, all of your data on the Service may be permanently deleted at the end of the trial, and we may not be able to recover it.

Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on an annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or PushFlew cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting PushFlew customer support team.

A valid payment method, is required to process the payment for your Subscription. You shall provide PushFlew with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize PushFlew to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, PushFlew will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

RULES OF CONDUCT

You agree to not use the Service to send notifications which contain any information, data, text or other content that is unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable, or infringes our or any third party’s intellectual property or other rights, harassing, blasphemous, pornographic, pedophilic, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever, contain any material or non-public information about companies without the authorization to do so; contain any trade secret of any third party, belongs to another person and to which you do not have any right to use; impersonates another person; violates any law for the time being in force; harms minors in any way.

TERMINATION

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

ACCOUNTS

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

OWNERSHIP

You may not claim intellectual or exclusive ownership rights to any of our products. All products are property of Ebizon. They are provided “as is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to, direct, indirect, special, incidental or consequential damages or losses that occur out of the use or inability to use our products.

SITE CONTENT

All site content, including imagery and documentation that is published on staging.pushflew.com is the property of Ebizon. Any replicated site content must be authorized in advanced. Content from this site shall not be used or exploited for commercial or non-commercial purposes without the prior written consent of Ebizon.

REFUND POLICY

As we are offering non-tangible digital goods, we do not generally issue refunds after the purchase has been made. We will be happy to consider a refund within the first 30 days of your purchase if you are unable to get the plugin to install properly on your website or if the plugin fails to perform the basic functions as designed and you have worked with our product support team to try to resolve these issues. Refunds will be granted at the sole discretion of Ebizon. No refunds will be given after 30 days from the initial purchase. Please note that by purchasing the plugin, you agree to the terms of the Refund Policy.

SUPPORT

Support is offered via a license key. Purchasing a license gives you access to our Support Ticket system.
Support and access to our automatic product update system are provided for a term of 1 year from the time of purchase. After 1 year a license renewal will need to be purchased in order to continue receiving support and product updates.
License holders are not permitted to re-post support content or documentation on any external websites, social media outlets, etc. Posting screen captures of this content is also prohibited. Violation will be grounds for immediate termination of the license, all access to support content and product updates will be discontinued.

TRANSACTIONAL EMAILS

Ebizon may on occasion send you email notifications related to your Pushflew services. These transactional emails may include notification of licensing changes, changes to our terms and conditions, license expiration notices and other transactional emails related to your purchase of PushFlew services.

PRICE CHANGES

Ebizon reserves the right, at any time, to modify or discontinue, temporarily or permanently, a license with or without notice. Prices of all products are subject to change. Notice of price changes will be made on the site.

WARRANTY

Our plugin is guaranteed to function on a clean installation of website on a properly configured web server. We do not guarantee it will function with all 3rd party plugins, with all web browsers, with all web hosts or if it has been modified by 3rd party developers. We are not responsible for any plugin compatibility conflicts that may occur. It is our policy to support our plugins as best we can and we will provide support for 3rd party plugin conflicts at our discretion or as time allows. We are not responsible for any data loss or other problems that may occur as a result of installing this plugin.

By purchasing our product(s) you indicate that you have read and agree the Terms & Conditions detailed on this page.
